CONDICIONES GENERALES DE CONTRATACIÓN

www.aleluyabcn.com (en adelante, la Web) es un sitio web propiedad de Alejandro Emina (en adelante, el PROPIETARIO) con NIE X6524171Z y domicilio en Calle Elisabets, 2, Local 1 08001 Barcelona.
El acceso, reproducción y uso de los servicios de la Web requiere la aceptación previa de las Condiciones de Uso vigentes en cada momento; el PROPIETARIO se reserva el derecho de modificar dichas Condiciones cuando lo considere oportuno, mediante la publicación del nuevo texto en la Web. Es responsabilidad del usuario conocer las Condiciones de Uso antes de acceder a los productos y servicios de la Web; en caso de no estar conforme con las mismas, por favor, absténgase de utilizarla.

PROPIEDAD
La Web es una obra compuesta de diversos elementos integrados e inseparables (texto, ilustraciones, fotografías, imágenes animadas, vídeos, programas de ordenador, incluidos los códigos html del sitio web, etc.), cuya Propiedad Intelectual le corresponde al PROPIETARIO , salvo en lo referente a aquellos materiales obtenidos bajo licencia de terceros.
El PROPIETARIO y sus licenciantes retienen en todo momento la Propiedad Intelectual sobre la Web y sobre los distintos elementos que la componen, individualmente considerados, en todas las copias que se realicen (cualquiera que sea el soporte al que se incorporen), concediendo sobre los mismos únicamente los derechos de uso que más adelante se describen. Cualquier derecho que no sea expresamente cedido se entiende reservado.
Además de lo anterior, el PROPIETARIO es responsable de la selección, diseño de la estructura y disposición de los contenidos de la Web, así como quien ha tomado la iniciativa y asumido el riesgo de efectuar las inversiones sustanciales orientadas a la obtención, digitalización y presentación de la misma, correspondiéndole, por tanto, la protección que el artículo 12 y el Título VIII del Libro II de la Ley de Propiedad Intelectual pueda conceder sobre el sitio web, considerado como una base de datos.
El PROPIETARIO es también el único propietario del diseño e imagen gráfica de la Web, reservándose las acciones que legalmente le correspondan contra las personas que pudieran realizar imitaciones o usos desleales del mismo.
CONTENIDOS WEB Y DESCARGAS. USOS PERMITIDOS
Está permitida:
● La navegación por la Web, es decir, el acceso y visualización de la misma en un dispositivo, quedando autorizada cualquier reproducción temporal o accesoria, siempre que la misma no sea voluntaria y forme parte integrante y esencial del proceso tecnológico de transmisión. La navegación por determinadas secciones de la Web requieren el previo registro.
● Previo registro, beneficiarse de los servicios y ventajas prestados por el PROPIETARIO a través de la Web a sus usuarios, en las condiciones que se señalen expresamente en las distintas secciones
● Quedan prohibidas cualesquiera operaciones respecto de la Web, sus contenidos, los productos descargados y las copias de todos ellos que sean contrarias a la Ley, las buenas costumbres y la buena fe y, especialmente:
o Cualquier utilización fuera del ámbito personal y privado, especialmente aquellas que tengan fines comerciales o profesionales, incluido el envío de publicidad o mensajes y la recopilación y tratamiento de datos de terceros.
o Cualquier tipo de extracción, comunicación pública y/o transmisión, total o parcial, por cualquier medio, fuera del ámbito privado de uso permitido y, especialmente, su incorporación a cualquier otra obra, incluidas páginas web, colecciones o bases de datos. Se exceptúa de esta prohibición la publicación en medios de comunicación de los materiales susceptibles de descarga de la sección Sala de Prensa.
o La remoción, ocultación o falseamiento de los avisos y advertencias sobre la Propiedad Intelectual o Industrial de la Web o de cualquiera de los productos facilitados a través de la misma.
o Las operaciones y actividades expresamente prohibidas en cualesquiera otras secciones de estas Condiciones Generales y, en general, cualquiera que pueda perjudicar el normal funcionamiento de la Web, a otros usuarios o a cualquier tercero.

LINKS A LA WEB
Queda autorizado el establecimiento de vínculos e hipervínculos con la Web desde otras páginas o sitios web, siempre que los mismos no se hagan de forma que perjudique la imagen pública y de marca del PROPIETARIO , de la Web o de cualquiera de las personas y productos a que se haga referencia en la misma. En el establecimiento de vínculos con la Web queda expresamente prohibida la utilización de técnicas que impliquen confusión sobre la identidad y propiedad de los contenidos, tales como el framing u otras.
Queda prohibido el establecimiento de vínculos desde páginas o sitios web cuyos contenidos promocionen o hagan apología, directa o indirectamente, de cualquier tipo de violencia, discriminación, pornografía o actividad ilegal. Asimismo, queda expresamente prohibido el establecimiento de links con fines mercantiles.
En la creación de los vínculos queda expresamente prohibida la utilización de elementos extraídos de la Web, sin el consentimiento previo y expreso del PROPIETARIO.
En ningún caso podrá entenderse que los vínculos a la Web desde páginas o sitios web de terceros implican relaciones del PROPIETARIO con los titulares de éstos, ni implica respaldo, patrocinio o recomendación alguna del PROPIETARIO sobre los mismos, por lo que el PROPIETARIO no será responsable en absoluto respecto de su contenido y licitud.

CONTENIDOS Y COMPORTAMIENTO DEL USUARIO
Como cliente o usuario de la Web te comprometes a hacer un uso adecuado de los contenidos y servicios ofrecidos a través de la misma, y a no emplearlos para (i) incurrir en actividades ilícitas, ilegales o contrarias a la buena fe y al orden público; (ii) difundir contenidos o propaganda de carácter racista, xenófobo, pornográfico, de apología del terrorismo o atentatorio contra los derechos humanos; (iii) provocar daños en los sistemas físicos y lógicos de la Web, de sus proveedores o de terceras personas, introducir o difundir en la red virus informáticos o cualesquiera otros sistemas físicos o lógicos que sean susceptibles de provocar los daños anteriormente mencionados; (iv) difundir contenidos que atenten contra la imagen y reputación del PROPIETARIO o de terceros (v) atentar contra los derechos de Propiedad Intelectual, Industrial, de imagen, honor u otros que correspondan al PROPIETARIO o a terceros.
El PROPIETARIO tendrá plena libertad de decisión sobre si las colaboraciones y mensajes son finalmente publicadas en la Web o no, quedando facultada para retirarlos cuando estime oportuno.
La infracción de cualquiera de las normas contenidas en estas Condiciones de uso y, muy especialmente, de lo previsto en la presente cláusula, facultará al PROPIETARIO para darte de baja de forma inmediata como usuario o suscriptor de la Web.

DATOS DEL CLIENTE: REGISTRO, MODIFICACIÓN, POLÍTICA DE SEGURIDAD Y CONFIDENCIALIDAD
Para realizar sus compras en nuestra tienda o acceder a determinados servicios, deberá registrar sus datos personales y elegir una contraseña que le permitirá acceder a todas aquellas zonas que requieran una identificación previa. Esto evitará que, en lo sucesivo, tenga que volver a cumplimentarlos. Por ello, las transacciones comerciales son realizadas en un entorno de servidor seguro bajo protocolo SSL (Secure Socket Layer) y todas las comunicaciones se transmiten encriptadas bajo un cifrado de 128 bits, que asegura el mayor nivel de protección a las comunicaciones.

FORMAS DE PAGO
Podrás pagar tus compras mediante:
- Tarjeta de Crédito
Visa, Master Card y American Express han desarrollado un sistema para realizar de forma segura pagos en Internet. El sistema de Comercio Electrónico Seguro se basa en que el Emisor de la tarjeta (banco o caja de ahorros) identifique al titular de la misma antes de autorizar el pago por Internet.
AleluyaBcn ha establecido una pasarela segura de pago mediante la plataforma Stripe. Se trata de una plataforma de pago seguro mediante el cual, una vez seleccionado el producto a comprar e introducido el número de su tarjeta, se abre una ventana del Emisor que le solicita su identificación
Los datos de su tarjeta y su contraseña quedan protegidos mediante el sistema de seguridad establecido en la plataforma Stripe desde el momento de su introducción.
Una vez completada la identificación, el Emisor comunica a AleluyaBcn que la compra la está realizando el titular de la tarjeta, de forma que éste pueda completar el proceso.
Esta ventana está fuera del control de AleluyaBcn, siendo responsabilidad de la plataforma Stripe cualquier incidencia que pueda surgir con la misma.

PLAZOS DE ENTREGRA
Los plazos de entrega cambian según su ubicación. El plazo general de entrega en España es de 24-48h. Para Europa 1-2 días. Y resto del mundo puede variar de 3 a 10 días laborables. En todos los casos excluyendo sábados, domingos y festivos. Este plazo puede variar según el domicilio de destino. AlelyuaBcn no será responsable de los retrasos que se produzcan por causas ajenas a su gestión o fuerza mayor.
Para la realización de los envíos, AleluyaBcn contrata los servicios de reparto de Envialia World S.L.

GASTOS DE ENVÍO
Los gastos de envío varían según la ubicación de destino. También disponemos de gastos de envío gratuitos dependiendo de la cantidad de la orden y el lugar de envío. Disponéis de dicha información automáticamente al realizar el pedido, siempre antes de realizar el pago.

CAMBIOS Y DEVOLUCIONES
Derecho de desistimiento
El cliente dispone de 14 días naturales desde la recepción del pedido para desistir voluntariamente de su compra, sin penalización alguna y sin indicación de los motivos de la misma.
El producto se deberá devolver en perfectas condiciones. Los productos para lo que ejerzamos este derecho no podrán haber sido usados y deberán ser devueltos junto con el embalaje original, su etiqueta sin romper, así como con todos los accesorios con los que fue enviado
El cliente deberá asumir los costes del envío por devolución. No se aceptarán en ningún caso envíos a portes debidos.
El cliente se hace responsable de que el producto sea devuelto en perfecto estado por lo que deberá escoger cuidadosamente el embalaje, así como también deberá empaquetar el producto de una forma adecuada, a fin de evitar un deterioro del mismo durante el transporte.
Una vez recibido el producto, AleluyaBcn verificará que el estado corresponde a las anteriormente descritas y notificará mediante correo electrónico la aceptación del derecho de desistimiento. De ser así se procederá al reintegro de su importe en los términos establecidos en el RDL 1/2007, conforme a la modalidad de pago realizada por el cliente, salvo pago en efectivo, que se reintegrará mediante transferencia bancaria.
Cambios
Solo se aceptarán cambios entre los mismos artículos, ya sea por ser defectuosos o por que la talla elegida en el momento de la compra no era la correcta. En ese caso se deberá poner en contacto con AleluyaBcn para explicar el motivo del cambio y así poder comprobar la disponibilidad del producto en nuestros almacenes.

Procedimiento
Para realizar tu devolución, debes contactarnos por correo electrónico a la siguiente dirección: customerservice@aleluyabcn.com y esperar por las instrucciones.
No se aceptan devoluciones en la tienda física, solo pueden ser hechas a través del servicio de correo. Los costes de devolución serán asumidos por el cliente según se recoge en la LGCU.

ERROR EN EL ENVÍO
En caso de que el cliente reciba un producto equivocado o en mal estado, o en caso de pérdida o daños de productos por parte de la mensajería, el cliente podrá solicitar su devolución y/o reposición, dentro de los 2 días naturales posteriores a la entrega del mismo. En tal caso nos comprometemos a asumir los costes de envío de la devolución, nos encargaremos de recoger el producto defectuoso y/o restituir el producto faltante por otro producto idéntico sin coste adicional para el cliente.

MODIFICACIONES
El PROPIETARIO se reserva el derecho de efectuar, sin previo aviso, las modificaciones que considere oportunas en la Web, pudiendo cambiar, suprimir o añadir tanto los contenidos y servicios que se presten a través de la misma, como la forma en la que éstos aparezcan presentados o localizados.
Aunque el PROPIETARIO pondrá sus mayores esfuerzos en mantener actualizada y libre de errores la información contenida en la Web, no ofrece garantía alguna respecto de su exactitud y puesta al día. Tampoco está garantizada la obtención de ningún resultado o fin concreto, por lo que el acceso y utilización de la Web es de exclusiva responsabilidad de los usuarios y clientes.

ACCIONES LEGALES
El PROPIETARIO perseguirá el incumplimiento de estas Condiciones de Uso, así como cualquier utilización indebida de la Web o de sus contenidos, las infracciones de los derechos que le correspondan a ella o a sus licenciantes, especialmente los de Propiedad Intelectual e Industrial, ejercitando todas las acciones, civiles y penales, que le puedan corresponder en Derecho.

PAYMENT METHODS

DELIVERY TIMES
You can receive your order at your home, or pick it up at our store

RETURNS & EXCHANGES
Right of withdrawal
The customer has 14 calendar days from the receipt of the order to voluntarily desist from his purchase, without any penalty and without indicating the reasons for it.
The product must be returned in perfect condition. The products for which we exercise this right may not have been used and must be returned together with the original packaging, its label without breaking, as well as all the accessories with which it was sent

Once the product has been received, AleluyaBcn will verify that the state corresponds to those previously described and will notify by email the acceptance of the right of withdrawal. Changes
Only changes between the same items will be accepted, either because they are defective or because the size chosen at the time of purchase was not correct. In this case you should contact AleluyaBcn to explain the reason for the change and thus be able to check the availability of the product in our stores.

Process
To make your return, first you must contact us by email at the following address: customerservice@aleluyabcn.com and wait for the instructions. 
Returns are not accepted in the physical store, they can only be made through the mail service. The return costs will be borne by the customer as set out in the LGCU.

ERROR IN SHIPPING
In the event that the customer receives a wrong product or in poor condition, or in case of loss or damage of products by the courier, the customer may request its return and / or replacement, within 2 calendar days after the delivery of the same. In this case we are committed to assume the costs of sending the return, we will pick up the defective product and / or return the missing product for another identical product at no additional cost to the customer.

MODIFICATIONS
